The rules of the road
By creating an account or using docs.realestate you agree to these terms. They set out what we deliver, what we ask of you, and what happens if things go wrong. Written in plain English wherever we could.
1.Acceptance
These Terms of Service form a binding agreement between you and Spinfoam VOF ("we", "us", "docs.realestate"), a Belgian company registered in Belgium. By creating an account, signing in, or using any part of the docs.realestate service, you confirm you have read, understood and accepted these terms.
If you are creating an account on behalf of an organisation, you confirm that you have authority to bind that organisation. If you disagree with any part of these terms, you must not use docs.realestate.
2.Definitions
- Service — the docs.realestate web platform, mobile apps, and any related APIs.
- Account — a customer workspace on the Service, associated with one or more users and a set of real-estate profiles.
- Content — everything you upload or create on the Service: documents, category structures, building and unit records.
- Admin — a user with elevated privileges on an Account (invite others, manage roles, delete content).
- User — anyone with sign-in access to the Service.
3.Eligibility and account creation
You must be at least 18 years old to create an account. You agree to provide accurate information at registration and to keep it up to date.
You are responsible for maintaining the confidentiality of your credentials and for every action taken through your account. Notify us immediately at security@docs.realestate if you suspect unauthorised access.
We enable two-factor authentication for every account; we strongly recommend you activate it.
4.Your content, your ownership
You retain full ownership of every document, plan, note and category structure you upload to docs.realestate. Nothing in these terms transfers ownership of your Content to us.
You grant us a limited, non-exclusive, worldwide licence to store, transmit, display, and process your Content — but only to the extent necessary to provide the Service to you and the members of your Account. This licence ends when you delete the Content or your account.
You warrant that you have the right to upload every piece of Content and that doing so does not infringe anyone else's rights (including copyright, privacy, or contractual obligations).
5.Acceptable use
You agree not to use docs.realestate to:
- Upload or share Content that is unlawful, infringing, defamatory, or deliberately misleading.
- Store personal data of third parties (tenants, contractors, etc.) without the appropriate legal basis under the GDPR.
- Attempt to gain unauthorised access to any Account other than your own, or to any part of our infrastructure.
- Introduce malware, ransomware, or any harmful code.
- Interfere with the Service's normal operation (denial-of-service, excessive scraping, automated bulk operations without prior consent).
- Resell or re-license the Service without a written agreement with us.
Serious or repeated breaches of this section may result in immediate suspension or termination of your account.
6.Plans, fees and billing
docs.realestate offers a free plan (up to three real-estate profiles per account) and paid plans that scale with the number of profiles and features you require. Current pricing is published at docs.realestate/#pricing and forms part of these terms.
Paid plans are billed in advance (monthly or annually). Fees are exclusive of VAT unless stated otherwise. Belgian VAT rules apply. Payments are processed by our payment sub-processor; we never see full card details.
If we change our prices, we will notify existing paying customers at least 30 days in advance. New prices take effect at the next renewal.
Refunds: as a professional service, docs.realestate does not provide refunds on partial-month usage. Consumer customers within the EU may exercise their statutory 14-day right of withdrawal for subscriptions started less than 14 days ago, unless they have already begun to actively use the paid features.
7.Availability, changes to the Service, and support
We aim to keep the Service available and performant. We do not promise a specific uptime percentage in these general terms — enterprise customers requiring a written SLA should contact us to arrange one.
Planned maintenance is announced in advance whenever possible. Unplanned outages are communicated via status page and email.
We may add, modify or remove features from time to time. If we remove a feature that materially degrades the Service you paid for, we will notify you in advance and, at your option, refund the unused prepaid portion of your fee.
Support is provided by email at support@docs.realestate. We aim to respond to most requests within one business day.
8.Suspension and termination
You may close your account at any time from the profile settings page. Deletion is final after a 30-day recovery window, during which you can restore the account by signing in again.
We may suspend or terminate your account, with or without notice, if:
- You materially breach these terms.
- Your account is used for illegal activity or Content.
- You fail to pay fees due.
- We are required to do so by law.
After termination we will delete your Content in accordance with our Privacy Policy. You are responsible for exporting anything you want to keep, using the built-in export tools, before account deletion becomes final.
9.Warranties and disclaimers
The Service is provided "as is" and "as available" to the extent permitted by law. To the maximum extent permitted, we disclaim all implied warranties including fitness for a particular purpose, merchantability and non-infringement.
You are responsible for keeping your own independent backups of Content that is critical to your operations. While we take backups on our side (see the Privacy Policy), those exist for our disaster recovery, not for restoring individual customer deletions.
Nothing in this section limits any statutory rights that consumers enjoy under Belgian or EU law and that cannot be waived by contract.
10.Limitation of liability
To the maximum extent permitted by law, our aggregate liability under or in connection with these terms is limited to the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim.
We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, or business opportunities, even if we were advised of their possibility.
Nothing in this section limits our liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation.
- Any other liability that cannot lawfully be excluded or limited under applicable Belgian or EU law.
11.Your indemnity
You agree to indemnify and hold us harmless from any third-party claim arising out of:
- Your Content, including any claim that it infringes intellectual property rights or violates the GDPR;
- Your breach of these terms;
- Your misuse of the Service.
12.Intellectual property in the Service
Everything about the Service that is not your Content — including the software, design system, brand marks, and documentation — belongs to Spinfoam VOF or its licensors. Nothing in these terms grants you any right in that intellectual property beyond the limited right to use the Service as provided.
Feedback or ideas you send us about the Service may be used by us without restriction, unless we agree otherwise in writing.
13.Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify you by email or via an in-app notice at least 14 days before the change takes effect. Continued use of the Service after the effective date of the change constitutes acceptance. If you disagree, close your account before the effective date.
14.Governing law and jurisdiction
These terms are governed by Belgian law, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Any dispute arising out of or in connection with these terms is subject to the exclusive jurisdiction of the courts of Ieper (Ypres), Belgium, save that consumers may bring proceedings in the courts of their place of residence to the extent required by applicable law.
Before starting formal proceedings we encourage you to contact support@docs.realestate so we can try to resolve the matter directly.
